What the regulations say:
There are 37 individual regulations within the Control of Asbestos Regulations 2006. The following is a very brief summary of some current asbestos legislation which is appropriate to most UK companies:
Regulation 4 – Duty to manage asbestos in non-domestic premises
It is a legal requirement that any non domestic property within the United Kingdom has an appraisal for the presence of asbestos containing materials. This can also apply to properties managed by domestic landlords and associations. This appraisal must be documented and should the presence of asbestos be identified then it is a legal requirement to manage this risk.
Regulation 5 – Identification of the presence of asbestos
No work shall be undertaken in demolition, maintenance or any other work which exposes or is likely to expose employees to asbestos in respect of any premises until an assessment has been conducted to ascertain the presence of asbestos, its condition, and its type. If there is any doubt then asbestos shall be presumed to be present.
Regulation 6 – Assessment of work which exposes employees to asbestos
An employer shall not carry out work which is likely to expose an employee to asbestos.
Regulation 10 – Instruction and Training
Every employer shall ensure that adequate information , instruction and training is given to those employees who are liable to be exposed to asbestos. This training shall be repeated at regular intervals.
